The
Ruling Concerning al-Hukm By
Shaykh Abul-Hasan al-Misree Allaah
the Glorified and Exalted said: ‘‘Have
you not seen those who claim to believe in what was revealed to you (O
Muhammad) and what was revealed before
you? They wish to refer legislation
to the taaghoot (false deities),
whilst they were commanded to reject it, and Shaytaan wishes to lead them far
astray. And when it is said to
them, ‘‘Come to what Allaah has revealed, and to His Messenger,’’ you
see the hypocrites turning away from you in aversion.
So how will it be when disaster strikes them because of what their hands
have put forth, and when they come to you swearing by Allaah, ‘‘We intended
nothing but good and success.’’ Those
are the ones about whom Allaah knows what is in their hearts, so turn away from
them (i.e. do not fight them), but
admonish them, and speak to them an effective word.’’ [Sooratun-Nisaa‘
4:60-63] So
those who are mentioned in these noble aayaat
- in the beginning - are not disbelievers: ‘‘Those
who claim to have believed in what was revealed to you…’’ In spite of
this, it has been stated about them that they, ‘‘refer
the legislation to the taaghoot.’’
So due to that, Allaah said about them, ‘‘And
when it is said to them, ‘‘Come to what Allaah has revealed, and His
Messenger,’’ you see the hypocrites turning away from you in aversion.’’
So by way of action, they turned away and did not answer, they referred
the legislation to other than the Sharee’ah
(Law) of the Lord of the Worlds. So
when they are spoken to, or advised, or commanded and prohibited, to leave what
they are upon from corruption and wickedness; they change positions and plead
weakness, and a number of excuses with their tongues.
‘‘We intended nothing but
good and success.’’ The
positions of their hearts are not hidden from Allaah the Glorified, nor is the
content of their hearts veiled from Him; they contain that which, could truly be
clear disbelief (kufr)!!
‘‘They are the ones about
whom Allaah knows what is in their hearts…’’ However,
when they - along with their leaving the Rule of Allaah - affirm that the Rule
of Allaah is the truth, and that anything other than it is false, and they do
not reject it (juhood), nor deny it (takdheeb),
nor oppose it; then the position that is to be taken concerning them is: ‘‘So
turn away from them (i.e. do not fight them),
but admonish them, and speak to them an effective word.’’
So what is obligatory to do with a person upon the likes of this
condition, is to turn away and to advise, not to perform takfeer
(declaring disbelief) and fighting. So
if they were to be declared disbelievers solely based upon their actions,
without differentiating between action (’amal)
and belief (i’tiqaad), ‘‘then
they would be considered to be disbelievers, and it would be obligatory to fight
them! However, this (takfeer)
is in opposition to the Book and the Sunnah
and the ijmaa’ (consensus) of the Salaf.’’

with them in such a manner, and Allaah is the Guide to the best course of
